Have you run the scene with the collada models present? Sometimes such errors correct themselves at runtime so you will need to check that first. Secondly, Daz models can only be used in-game with a game kit license and only models made by Daz not those sold in the marketplace. The game kit comes with a FBX exporter and produces slightly more stable and corrected meshes, however, the fbx needs converting. As far as I am aware a game kit license is required whether the game is commercial or not.

question can Daz studio 4 character's be used in commercial game dev without a licence?

I think StuporMundi answered that in his post. Though it appears that you could buy a character from the DAZ storefront and use that without a licence. It should be noted that DAZ and Torque 3D are not the greatest fit since the models have high poly count and are better for renders. Of course they could be made to have less detail.

If I could make a suggestion, check out MakeHuman, Blender and the MakeHuman plugins and tools for Blender.

No. You need a licence period. You could buy a character from the storefront but you would have to contact the vendor to ask permission to use it in a game, the daz license does not cover third party models. The same goes for Poser.

The daz decimator is not much good and it would be somewhat difficult to reduce poly count on a skinned mesh model without requiring a uv map redo.

Turbosquid do have some free models that can be used, at best they will be rigged but not animated. As mentioned, blender is probably the best bet. I believe Blender swap also have free animated models, however, one has to be aware that there are quite a few models on that site that are posted there illegally so definitely caveat emptor.

Really Blender is the best open-source 3D Modeling Program and as far as I can tell, Make Human is the only open source program of it's kind. I haven't delved in too deeply but I'm impressed that you can import a fully rigged and weighted model into Blender with a couple clicks.
