[Solved] A question on a fan based game for TGB

by NeoStorm · in Torque Game Builder · 03/09/2012 (6:02 pm) · 8 replies

Hello everyone!

I apologize if I offend or pissed anyone off with my noobish question.

I have messed around with the tutorials and read some documentations relating to TGB to know that I can make a fan based game. I am currently working on a fan based trading card game (think of Yu Gi Oh and Magic: The Gathering). However, the fan based tcg I have in mind is not related to either.

I have a question pertaining to the creation of the fan based game.

1. I have read the EULA of GarageGames several times but I honestly admit that I always tend to forget about 50% of what I read.
Does GarageGames allow me to use the engine to create fan based games?

edit:I forgot to add that the fan game is noncommercial and nonprofit.

@NeoStorm - We do not prevent you from doing anything. However, if an owner of the IP that has inspired your game decides to litigate, we would not be liable or able to help in anyway.

I appreciate the response.

I wanted to make sure whether GarageGames would take action upon it.
I understand about the risk of the owner of the original game taking action.

Thank you for answering Michael.

I wouldn't intend only selling a fan based game in the USA without requiring rights. Alot of those fan based games that are making money off of other ip's, are made and server based in other countries such as Korea which has no ip laws and they can replicate anything. Fan based games make good portfolio pieces though because good ones attract the fans. Get a lot of fan downloads and you'll gain popularity for your personal games.

@Thomas; Sorry for being vague.
I forgot to add that the fan based game is entirely non profit.

I have no intentions to make any profit from it.

I enjoyed it a lot but there were never enough tcg players around me.
So I felt that I should make an online fan game to help publicize it.

If your not going to charge money for it, I woulnd't worry too much about it.

If it's non-profit, I see no reason why you shouldn't be able to do it.

There is a slim chance that the owners of the IP may issue a cease and desist if the project becomes very popular. However, it's very unlikely. The only times I've ever heard such a thing was when Nintendo squashed a non-profit fan-made Super Smash Brothers game that you could import to your DS using an SD card.

I've seen plenty of articles on IP owners going after hobby and indie projects, even if they have no plans to make money off of them. The more popular the project, the more likely it will draw the attention of the IP owners. Although, there have been a few notable exceptions as of late. It's a risk, either way.
