FMOD EULA: Indie vs Commercial

Got a question about the FMOD addon.
We are building a game. The game is being built by a legitimate "company" but the "company" is 100% independent and has produced absolutely no revenue. The game in question is what we are hoping will kickstart us as a typical revenue generating company :) We have received absolutely no funding and any money that has gone into our costs has come from the team and not by any outside sources.
The game we are building is on T3D and we have a couple developers and a sound engineer who just happens to be a developer also. Our sound engineer will be doing all of the FMOD manipulation; i.e. he is the only one working w/ the FMOD code. But due to the way the addon needs to be integrated into T3D, the FMOD addon will be "living" on everyone's working copy of the game because its integrated w/ the engine.
Does this violate the "indie" EULA?
