I was wondering if i could build off of TGEA, like upgrading TGEA, ( wich is possible) but i was thinking if i could make my own game engine around Torque?

In definition, any code change you make as a customization for your 'game' project could be considered a new game engine. But you are not allowed to hand out your 'new' game engine and its source code, as much of the code base is property belonging to GarageGames.
Google research 'intellectual property rights' and read the license agreement from GG.

Legally? No. You can not use someone else TECH what is under license to you, to build a comparable standalone product. I meant in the way of it beign possible as programming, but now i know that even if it is nothing like TGEA, ( because i modified it) i could not sell it as an official game engine, but i could still sel the games i make with it.

You can absolutely modify Torque to your heart's content for use on your own projects, just not to be licensed without our permission. That why we ship with source code.
