If you make a game based on someone else IP without licensing it you can and most likely WILL be sued regardless of wether or not you charge money for it. Useing trademark without licensing it dillutes the trademark, if they DON'T sue you they run the risk of losing their trademark. If they have a game based on their IP they can show that your free game hurts thier game's sales and sue for damages.

Use Warhammer as a reference ruleset but don't ever use any of their names or other IP or you're toast.

The "law" won't help you if Games Workshop decides to send you a legal notice telling you to stop. Do yourself a favor and, if you *really* want to do this, then try to contact their legal department and ask them. They may send you a letter giving you permission, in writing, to continue the project as a *non-profit* game.

Seeing as they already have games based on this IP out there, they already know it can make money and will not give you permission to make something to gain money from, especially since they've probably got a contract with the game company who made the old games.

Otherwise, I too say give up =(

Yeah, they do give permission to fan websites, which is nice.

However, I do know that Games Workshop shuts down fan _games_, they've done it before.

Make sure they know you're talking about a game and not just a website.

To be fair it's not usually GW that shuts down the various mods / computer games. It's the company that have currently licensed the property.

Must say these threads are amusing... when you say looking for help / Team members you want Lawyers right? ;)

Shame GW never have any good 40K games, it's such a fantastic universe...

I think its cheap to try and clone tabletop games. Ive played table top rpg's and strategy games for my entire life. Why not try and make something better than the same old wh40k?

Why not create a 40k game. Sounds like fun. To play out an entire battle on a PC would be alot faster then playing it on the table top IMHO.

The reason they dont want you(or anyone) to make a free game based on their property is because they have no quality control.

Imagine if you had spent years creating a valuable market share for a quality product and then someone makes a product under your name that is not of the same quality (can you say cheesy or suckwind)... it would tarnish your product and the value of it.

I am not saying that you would make a cheesy game, I am speaking in general here.

Now on the other hand, I know that many companies have licensed their product to a "professional" game company and still ended up with stinky cheese, but I guess that is risk you have to take.

But I think the above issues are the reason behind companies suing people for using their stuff.
