tribes 2 community material

if a tribes 2 mod/skin/model etc. (made by the community, not official t2 stuff) says something like "you may use this in your mod if you give me credit" or something similar, can we use it in a V12 project? can we use it in commercial projects, or non-commercial projects, or both? this is of course assuming the original author gives permission.

made the post assuming that no original t2 stuff is used. i have little doubt of what dynamix would do about something with a single vertex or pixel that was theirs. theyll probably have something to say about maps made with their level editor too. and if you check out my project you would see why I want to find as many shortcuts as possible. Its not a lack of originality or work ethic, its practicality. I need to shave as many man-hours as possible off my project. Besides, all-new models arent what my game is about.

Besides, if you're making a shooter with guys running around with guns, jetpacks strapped to their backs, various armor-classes, et cetera, you're just ripping off Tribes 2 as you would if you'd used their stock game-provided models. So, make a truly original game with original models, and you should be good to go. Do not contribute to the entropy of the PC-game industry by creating more of the same old thing (is it that obvious that I think the market has stagnated?).
But, this is all assuming that the file format is the same. Just get a sworn affadavit from the modeler and have him sign a contract that says he is solely liable if Sierra/Dynamix feels the need to sue you, and you should be safe.
