Are people allowed to legally use the Torque Starter Kit items?

Hello. I am making a racing game, except a more "advanced" version. I don't want to give too much detail, because it is not copyright, or trademarked yet. But anyways, I was wondering if I would be allowed to take that tree off the starter kits and use them in my game. I mean, it's not like their is a company logo carved in the tree? Also, would I be allowed to use the GarageGames baja racer vehicle as a unlockable in my game? In the credits I am going to have to put "special thanks to GarageGames" anyways because it is their engine I am using. I don't really think there are any other important items that I would need to use from the starter packs. If you guys know of any models from the starter pack that could be useful for my game, please let me know.

@Shane - You can freely use any assets that ship with the SDK. You are only obligated to display a splash screen during game startup, unless you work out a compromise with GG.

Ok thanks. That pretty much answers it. Especially since a GarageGames employee answered it :)
This thread is still open to anyone that would like to suggest some items I can maybe use from the starter kits.

Wait. One question. Am I allowed to use the Orc as the main character for my game? Yes, I know that sounds cheezy but it is because I do not have the artist skills to create my own character with good looking graphics like the Orc and I also do not want to buy one.

EDIT: And what about publishing a prototype of a game using the Torque racing buggy? I want to use the buggy just to be able to test the riding on the roads/bridges/ramps. I might edit the 'car.cs' a little bit to get the effects I am looking for, though.
