Legal Eagles

I bought the TXB Indie License. The Eula says:

"Licensee agrees to display a full screen Torque X logo in the start up sequence of any game created and released with the Engine."

"Licensee agrees to include in the "About" box or in the credits screen in any game, software, or product created with this Tool: (i) a link to www.garagegames.com, and (ii) the wording 'This game powered by Torque X.'

Now I want to submit a game that I created with TXB and the Platformer Kit to the Dream-Build-Play 2008 contest.
Microsoft's official rules say:
"The entry must not contain any third-party promotion, marketing or advertising in any form or of any kind."

So: How do I get out of this catch-22 situation?

My own solution to this paradox would be:
I will clearly explain in my submission to this competition that I used TXB and the Platformer Kit and I will place a GarageGames logo on my splash screen of the demo. I think this should be o.k. at the moment because this is just an entry for a competition where some judges play this demo and because GarageGames and Microsoft are kind of related anyway (Creator's Club Members get TXB etc.).

What do you think?

I'd recommend that you contact licensing at garagegames.com.

Actually, I believe the intent of the Microsoft DBP terms is to prevent advergaming since all DBP games are destined to be rolled into the Community LIVE portfolio. So, the want to prevent entries like "Nike Kart Racer" and "Starbucks Cappucino Kong". But acknowledging a contributing technology, such as Torque X or Farseer, etc, should be fine.

Catch-22 situation resolved :-)

I got an email from GarageGames:
"I'm cool with you not including the splash screen or credits for the DBP submission only. If you publish your game commercially, we'd ask that you adhere to the EULA though."
