DTS import fails and crash in Constructor

Hey guys,
I posted this in two other sections so I'm sorry for the redundancy. I'm really desperate for an answer. Here's my problem:
I tried to import a simple box DTS from 3DS Max 7 AND 8. Each time I try to import the dts, Constructor crashes.
Any help or guidance will be great appreciated!

Its possible. It does seem odd that something as simple as a basic box would crash Constructor. I even made sure the size was half that of the blue man.

I can place it in torque level editor;
the shape will import to constructor as a reference object.
its a simple box with the minimum things for export to DTS: base node; start node; detail node; bound box. that's it
A more complex mesh, with the same exact setup, actually will import into constructor.
I'm just as stumped I guess.

Possibly a dodgy dts file? ..that would be the simplest answer I think.
Besides that I am at a loss.
