I noticed Gmax is free, is it legal to use for games.

No. Also it only lets you export/save to a native Gmax file.

If it has not change you have to buy there sdk which is alot money to build an export. If you like 3ds max it would be alot cheaper to buy LightRay3d. It has an export for Torque.

It's not just a matter of legality, you just can't use it for games as there is no way to use plugins / custom exporters.

The problem is the exporters were more than likely made illegally.
Honestly, it's just way to much of a risk to mess with. Pick up Silo or Hexagon or of you have to have direct dts exporting get LighRay3d, Gamespace, DeleD or (I can't believe I'm saying this) learn Blender...anything that is *clearly* licensed for legal use in your own work and not just for content for Mods.
Just my 2 cents.

Actually it is just a matter of legality, exporters do exist for GMax (Quake 3 MD3 format in particular), that can be opened with apps like Milkshape. You can't do dts directly and I don't think the node exporter is going to come out properly either, so that you could probably only use it for static models and then rigging them in Fragmotion or Milkshape. The problem is the exporters were more than likely made illegally.
