Sparks / Activision contract released to the public

Accidently posted this in the wrong forum before, heh.
Pretty sure this is a first in the industry....sparks and activision are in a legal battle over call of duty and their contract was entered as evidence..which means we all get to see it over on gamasutra. very interesting to read through, hopefully help some indies out, knowing what to expect, etc

Why should we hope that the little guy wins? Considering the Sparks has been in legal battles before, I can't see how you can judge Activision before the court has.

Still does show how good the indie license is in terms of IP mess in court etc.

Thats a good answer why to be good to be an indie :) ok, you never will to see a contract of 8.5m usd, but your nights will be even more rest(and peace)full :)

Seems like a basic development contract agreement to me, nothing fishy or low ball about it. Has a couple fussy areas that could have left Activision vulnerable though, especially in the timeframe area.

I'd read between the lines a bit more carefully. Activision was extremely high-handed in the deal, and the "little guy" had all sorts of high risk exposures with very little resolution capability.
Anywhere the comments said something like "this could be a conflict" means that if anything goes wrong, lawyers get involved--and who has more money for lawyers? The publishers.
