Use Indie or Commercial license?

by Sammy · in General Discussion · 11/11/2006 (6:21 pm) · 4 replies

Hi all,

1. If a single programmer program a whole game and have a publisher published for him/her,
should he use indie license or commercial license?

2. Moreover, if the game has contents designed by other artists, does he still considered as indie?

Thanks in advance.

If you're the only programmer messing with the actual engine source code (not the scripting code) then you can use the indie license, providing you make less than $250,000. If you make greater than that amount, you have to go commercial. If you have content from other artists, just make sure you have rights to use it commercially.

Your publisher's earnings count toward that $250,000 if I remember correctly. Also, if you are being contracted out to do Torqe programming, you will need a commercial license -- or at least that's the last official word that I've read from GG.

"(b) Licensee may not use the Indie License if the annual revenue of the Company employing, partnering, or affiliated in any way with the Licensee is greater than $250,000 annually. Companies that grow to greater than $250,000 annually must upgrade to the Torque Game Builder Pro Commercial Product License for each seat of Torque Game Builder Pro."

So don't buy it unless you're involved in a commercial activity with people making more than $250k/year.

Not a problem for a lone developer unless they're doing contract for someone else who meets this criteria. Or the one in a million shot that you start making more than $250k/year you can just buy the commercial tools then.

Or if you're developing non-game stuff like educational software, simulations, TGE powered accounting apps, etc.
