TorqueGameEngineSDK 1_3 license

I bought the Indie license for Torque and downloaded 1.2 using CVS. Recently I upgraded to 1.3 using the download link from "My Garage". When I went to install 1.3, I found that installation required acceptance of the license agreement which states:
" Licensee may not publicly distribute, release, publish and/or transmit any Games created hereunder or otherwise exploit the Software. Licensee must deliver all completed Games, ready for publication, to Licensor for exclusive release and publication through the Website, or through third party distribution channels (subject to separate agreement for payment terms). Licensee may distribute free demos of the Games through third party distribution channels. Free games may be distributed from Licensee's own web site."
The Indie license states:
"Licensee may have the Games published in any channel by any publisher with no royalties. Licensee does not have to offer the Games to GarageGames for publication."
Did I download the wrong thing or does the Indie license supercede the license in what I downloaded? Should I download using CVS instead? If so, what is the last stable version number to use when using CVS?

The EULA on the site is the correct one.

Hang on a minute..... Judith is right. The EULA quoted inside the TGE installer appears to be the old one. Wonder how that slipped by all the attentive developers! ;)

From memory, it's been fixed in the most recent installer for the RTS SK, but I haven't checked the 1.3 download since November or so (which is when the new installers came out roughly).

There are a couple of threads on this, but when they started using the new installer process, the old EULA was inadvertently used instead of the current (and correct, as Jeff pointed out).From memory, it's been fixed in the most recent installer for the RTS SK, but I haven't checked the 1.3 download since November or so (which is when the new installers came out roughly).

Thanks all. I was pretty sure that the Indie license still applied but I wanted to make sure before I used 1.3 from the download site. Sorry about missing previous threads on the subject. I did search the forum but I guess I didn't go back far enough.

The EULA on the site is correct, and we recently checked in the correct version into CVS too, but I guess the installer didn't get re-built. Apologies, it'll be fixed next week.
