We found out about this from Apple because they thought it was from us. We have prior use, so there will be no name change... on our part.

I think Jeff T will back me up on this, every single motorcycle related stunt scene in that movie is so far from reality it is not funny!

I HATE when hollywood really screws us motorcyclist like this. First BikerBoyz and now this . . . it mis-represents those of us that are NOT idiots on the street! It took decades of AMA diligence to stop stupid anti-motorcycle legislation and tonnes of Honda propoganda ( You meet the nices people on a Honda" campaign, to shake the "all bikers are gang members" stigma now hollywoood pushes the all bikers are "stupid stunter gang members" . . . glad I quit riding on the street so I don't get lumped in with these morons.

All the anti-motorcycle legislation would gain momemtuem right after a "biker" movie release, all the fundementalist valium popping housewives would write their letters to their congressmen to get bikes outlawed because they thought these hollywood fantasies were some kind of documentaries!

Just wait, there will be a movie representing all FPS game players as murdering drug dealing crank head gang members that recreate game scenes in real life, eventually! It will probably be called "FRAG" or some such non-sense.

with them suing anyone else who looks at one of thier names funny..

Such trademark lawsuits are only applicable in the same context or if they cause "reasonable confusion" amoungst consumers, it would be a complete waste of time. I don't think it is reasonable to expect consumers to think the movie and the game engine are related in any fashion much less the same thing.

Here is just a small example of references to the word 'torque' and 'game' in use that are not related to the torque game engine.

Yeah what the hell... it says "3D Torque Game" that's enough to sue their ass. Its close enough to the engine... LAWSUIT! :)

Interesting... seems like holywood is going to exploit everything car/bike related for a couple more years... I think the only good car movie I've seen was 60 seconds, but the rest.. ppfff.... just cars with lights and gorgeous babes. This is similar but with bikes. They don't deserve the Torque name :)

Actually, we have already had confusion. Apple Computer contacted us about the game because they thought it was ours. We are going to pursue this to at least the first level. We definitely have prior use.

Considering how technically terrible the Fast and the Furious was, I didn't expect they would improve it much :(

There was an excellent resouce posted here a while back (may have been in a forum post) linking to an awesome article on trademarks etc.

I think you'll find the English language has "prior use" covered for Torque... not very considerate of Warner Brothers. But look on the bright side, they spend millions on advertising, and GG beats them on the "Torque" google search. Awesome :)

Position on google has nothing to do with money and everything to do with WHO links to YOU.

Google bases "page rank" on who and how many links to your web site more than what the web site contains, because more links should equal more relevance. Also what the link says is very important also. Torque Game Engine[/ulr] would get a better page rank score than [url=www.garagegames.com/]GarageGames
