Torque 3D Legal

I'm a starting up developer and before I hop fully into Torque 3D I would love to know more about the licensing laws. I read in the EULA that for non-games the maximum revenue is 500k dollars, does this apply to game products as well? Also I noticed there was more than one license type, professional and studio. What are the differences?

I also want to know the contact email of garage games, I checked most everywhere on the site but couldn't find it.

Back in the day when the licensing was Indie and Commercial there was a $250k ceiling on revenue for Indie, after that you needed Commercial. With the changes to the license we made when we came back to make it easier to understand that restriction has been removed (mostly because we haven't used the Indie vs Commercial model in quite some time). The only revenue restriction is with non-Games.

Professional is an individual license that includes source code. This is licensed to a single individual only and can't be used by anyone other than that individual. Studio licenses are transferable seat licenses that you can assign to members of a team as they come and go and still retain ownership of the license itself.

We no longer sell Individual licenses and have single license model that is Studio only. This doesn't invalidate your current Individual Pro license though.

Thanks for clearing that all up.

If I start selling a game I make would I have to pay any fees to GG because I'm use the Torque engine?

The Pro license is "Royalty Free". That means no you don't.


Scott,
Does GG still offer distribution assistance? I read somewhere else the focus was just on the tech right now. Or is there still opportunity for distribution assistance with a cut taken out to cover costs?

Frank's correct, the license's for the engine's are Royalty Free. The only instance where you would possibly need to pay more later is if you exceed the revenue cap with a non-game, which is $500k, at which point you would need to contact licensing@garagegames.com for an upgrade to your licenses that would be a one time fee.

Unfortunately we're not really looking to act as a distributor/publisher again right now. We've chosen to really focus on the tech itself. The only distribution that we're really doing right now is for 3rd party add-ons and content packs for the engines. There's a possibility that we may resurrect the game store in the future and distribute games here on the site again, but that would be somewhere down the line if we did.

Looks to be a steam-like distribution client trying to get going. Terms don't look "too" bad (their cut is 15-25%) for hosting, autoupdating, sales, and access to an accounts system.
Of course that assumes they get past the development phase and start attracting customers.
