Pokemon 3D MMORPG!

Okay, guys this is Josh with Eclision Games. I just want to point out we have Hero Engine. We are aloud a team of 25 and have several spots open. If you want a spot on the roster we will love the support. We are going to make a Pokemon 3D MMO. Will fill all who join in with the legal details to keep this game legal. My buddy believes he will have over 150 pokemon from kanto modeled soon. he already has some modeled and animated. This game will be unique and fun. The fanbase will be great. We need any help we can get as long as you are dedicated, can get on skype, and can work(no bsing around alot). Game will be real time rpg style. No loading screens for battles. We are gunna run around as pokemon and battle dark pokemon. 3 pokemon will be available at char selection screen. Evolving will be unique as well too. game will be a blast to make and will be even more fun to say we made. If interested email me here. eclisione@live.com

All of what you said is untrue! You only need to have their permission and a licensed approval from Nintendo if you plan on making a game for one of their consoles. Or handhelds. otherwise you go in under as an independent. How else do you think people make all these Pokemon browser MMO's and 2d MMO's? They contact a lawyer to verify what laws they have on the matter or just keep game within the legal copyrights. Cannot charge subscriptions to players, or use the name ash in the game unless that is a players username. other law details i am aware of can be discussed if you wanna jump aboard, otherwise i would just be wasting my time.

Any lawyer telling you otherwise needs a dunce-cap. If there are MMOs out there that are hawking actual Pokemon IP, then I would check to see what country they operate out of. Companies can't always enforce copyright or trademark disputes because of the countries involved.
Now, if you do have permission, then you're golden, and if I were you, I'd wave that permission like Ole Glory to get people aboard ;)

IP is a case of use, in this situation, unless you're running a non-profit MMO? How do you intend on keeping the game running- advertising? Valid choice, of course, but that means that people are delivering ads on your network because of the content of your game (or put another way, people are forking over cash to them because they were drawn to your site showing the ad due to the content of your game). Either way, money changes hands.Any lawyer telling you otherwise needs a dunce-cap. Well our game engine is being all paid for by the company that makes it under a special promotion that we were selected for. Our servers, game, and upkeep are all paid for which gives us a great chance to make this game. We are allowed premium items and company donations. Both in which Nintendo has no control over. We just are not allowed the right to sell memberships. We are not using anything of Pokemon but the Pokemon themselves. The names too of course. everything else will be our own content not Nintendo's. we are based from the United States. We may even change the Pokemon to be a bit less cartoony and more realistic, that will depend on the game dynamics. But either way this will be a fun game to make as well as the popularity behind it.

You mentioned that your game engine is being paid for by a company so I'm assuming you have some good lawyers. I am looking forward to the progress of this MMORPG.

Alright well if you're sure that you have permission to then I don't mind joining your team. You mentioned all of the Pokemon browser MMO's and 2D MMO's. Those are people who just rip graphics and assume that its alright to use rights to a game as long as they don't charge. However, that is NOT the case. You still have to have written permission from Nintendo in order to use the Pokemon brand name in any media. If you're trying to justify that you can make your game because of others, then you might want to be careful because people have gotten cease and desist orders before.You mentioned that your game engine is being paid for by a company so I'm assuming you have some good lawyers. yea, look what happend to zelda world. A great game with a lot of fans. Programmed using torque 3d. They remade the ocarina of time as a non profit mmorpg, but once it got to popular they got in a legal battle with nintendo. I wish you the best of luck with the game just make sure you have everything legal before you work on it for two years and then it gets kanked.
