the site doesn't let me play Fallen Empire Legions or Rokkitball. It just redircts me to either a blank page or instantaction.com's old website that directs you to this site

It still says that torque will be running the games

Did you read what it said? It said *this* site will continue its services. InstantAction has shut down. The games on IA were not the same games *sold* here. This site is about game development and engines, primarily.

As InstantAction is no more the games are no longer available for play. Whether any of them see the light of day again will depend on the deals for those games and how IAC will handle it when they've finished reviewing their assets and contracts.
As far as I know, Legions is still coming back in the form of Legions:Overdrive and I've heard there may be a release for Ace of Aces in the future. That all of course depends on where the chips fall once everything is sorted out.

The message on InstantAction.com wasn't worded clearly enough, but they didn't have much time to word it better when the site had to come down and that message go up. The games made with Torque in that message referred to games that were already being sold via our store. As InstantAction is no more the games are no longer available for play.
