Alright some DTS and Free questions

Allot of people say things are free. Now to me free means free to other free means free for free projects.
Examples.. What about the things included with Torque? Can we use those? Could we use the scorched earth map in a comercial release? What about cat city in resources?
And last thing.. If there's a reason not to create diff objects? Why create a computer and make it a DTS file when I can create it in hammer and make it a diff file. Let me know the bonuses or each file type
