MP3s and Licensing.

We're trying to release a game for the iPhone using T2D. However, according to http://www.mp3licensing.com/royalty/games.html in case we sold more than 5000 units, we'd have to pay a $2500 royalty to Thomson. I'd just like to know if I'm reading this right, and what experiences others have had with paying the mp3 license, or if somehow independent game developers are exempt (very unlikely).

I'm pretty sure the mp3 licensing is covered by Apple under their developer program. I seem to remember this being asked before and that was the answer, I'll check to make sure.
